1. Definitions

  • "Cairnstone", "we", "us", "our" — the business trading as Cairnstone, located at 77/3 Klang Mueang Road, Nai Mueang, Mueang Khon Kaen, Khon Kaen 40000, Thailand.
  • "Service" — any of the document organisation, educational session, or records support services offered by Cairnstone, as described on our website.
  • "User", "you", "your" — any person who visits our website or engages with our services.
  • "Website" — the website operated by Cairnstone at cairnstonem.world.
  • "Engagement Agreement" — the written scope document agreed between Cairnstone and the client prior to commencement of paid work.

2. Acceptance of Terms

By using our website or enquiring about our services, you agree to be bound by these terms. Use of the website constitutes acceptance. Engagement with our paid services is formalised through a written Engagement Agreement, which takes precedence over these general terms in the event of any conflict relating to service delivery.

Our services are intended for individuals aged 18 years and over who have the legal capacity to enter into an agreement. By engaging with us, you confirm that you meet this requirement.

3. Service Description

Cairnstone provides document organisation support, general educational information sessions on record-keeping, and document inventory services. Our services are non-advisory in nature. We do not provide legal advice, financial advice, accounting, estate administration, or any service requiring a professional operating licence in Thailand or elsewhere.

Services are primarily delivered in person in the Khon Kaen area of Thailand, with remote arrangements available by prior agreement. We reserve the right to decline an enquiry or engagement at our discretion.

4. User Responsibilities

When using our website or engaging with our services, you agree to:

  • Provide accurate and complete information in any enquiry or session
  • Not misrepresent the scope or nature of documents you bring to a session
  • Not use our services for any unlawful purpose
  • Retain ownership and responsibility for all original documents at all times
  • Not reproduce, distribute, or commercially exploit materials produced by Cairnstone without written permission

5. Intellectual Property

All content on this website — including text, design elements, structural frameworks, and session materials — remains the intellectual property of Cairnstone. You are granted a limited, non-exclusive licence to access and use the website for personal purposes. You may not copy, reproduce, or redistribute website content without our written consent.

Inventories, indexes, and written summaries produced for you during a service engagement are your property upon payment and handover.

6. Payment Terms

Service fees are as published on our website and confirmed in the Engagement Agreement. All prices are stated in Thai Baht (฿). Payment is due prior to commencement of work unless otherwise agreed in writing.

Cancellation and refund: If you cancel a confirmed engagement more than 48 hours before the scheduled start date, we will provide a full refund. Cancellations within 48 hours of the start date may incur a cancellation fee of up to 50% of the agreed service fee. No refund is available once an engagement has commenced. Cairnstone reserves the right to reschedule sessions due to unforeseen circumstances.

7. Service Delivery Terms

  • The scope of each engagement is defined in a written Engagement Agreement signed before work begins
  • Any scope changes must be agreed in writing before additional work commences; additional fees may apply
  • Cairnstone will endeavour to complete work within the timeframe set out in the Engagement Agreement, subject to the client providing access to relevant documents
  • Original documents will not be removed from the client's premises at any time
  • All engagement outputs are provided to the client at handover; Cairnstone does not retain copies of document inventories beyond the engagement period unless agreed under a Companion service arrangement

8. Disclaimers

Cairnstone provides document organisation support and educational information only. Nothing in our sessions, materials, or website constitutes legal, financial, tax, estate administration, or professional advisory guidance of any kind. Families should consult qualified professionals for specialist advice.

The website and its content are provided on an "as is" basis. We make reasonable efforts to keep information accurate but do not represent that all content is complete or current at all times.

9. Limitation of Liability

To the fullest extent permitted under Thai law, Cairnstone's total liability for any claim arising from the use of our website or services shall not exceed the amount paid by you for the specific service in question. We are not liable for indirect, consequential, or incidental losses, including loss of data or documents not under our direct control.

Cairnstone is not liable for any failure or delay in performance resulting from events beyond our reasonable control (force majeure), including illness, natural events, or government-imposed restrictions.

10. Indemnification

You agree to indemnify and hold Cairnstone harmless from any claims, losses, or costs (including reasonable legal fees) arising from your breach of these terms, your misuse of our services, or any inaccurate information you provide.

11. Termination

Either party may terminate an engagement by giving written notice. In the event of termination by Cairnstone due to client breach of these terms, no refund will be provided for work completed. If Cairnstone terminates for reasons other than client breach, a pro-rata refund for undelivered work will be provided.

Clauses relating to intellectual property, disclaimers, limitation of liability, and dispute resolution survive termination of any engagement.

12. Dispute Resolution

These terms are governed by the laws of Thailand. In the event of a dispute, the parties agree to first attempt resolution through direct discussion. If no resolution is reached within 30 days, the dispute shall be referred to mediation in Khon Kaen before any formal proceedings are commenced.

The courts of Khon Kaen Province, Thailand, shall have exclusive jurisdiction over any dispute that cannot be resolved through mediation.

13. General Provisions

  • Entire agreement: These terms and any Engagement Agreement constitute the entire agreement between you and Cairnstone in respect of the subject matter herein
  • Severability: If any provision is found unenforceable, the remaining provisions continue in full effect
  • Waiver: Failure to enforce any provision does not constitute a waiver of that right
  • Assignment: You may not assign your rights under these terms without our written consent

14. Changes to These Terms

We may update these terms periodically. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our website or services following any update constitutes acceptance of the revised terms.
